Terms of Use

You must be at least 18 years old and legally capable of entering into a binding contract under the laws of Malaysia or Singapore, as applicable to your market, to register an account or make purchases on the Website. By using the Website, you represent that you meet these requirements.

The VIP Membership and Wellthy StarWell Programme (including the Referral Cash Reward Programme and the RM 1,888 Entry Deposit) are offered exclusively through the Wellthy Healthcare mobile app and are not available for purchase, enrolment, or redemption on the Website.

VIP Members do not receive their self-purchase discount on Website orders — the discount is available on App orders only, and VIP Members pay the full listed price when ordering through the Website. Website orders nevertheless count toward the VIP cumulative threshold (RM 5,000 in Malaysia / SGD 1,800 in Singapore) in the normal way, subject to the store link rules above, and earn base WE Reward points on the full listed price.

WE Reward points are treated differently. Base WE Reward points are earned on Website orders as well as App orders, by all customers including non-members, at a rate of 100% — one point for each RM 1 of the Applicable Price. Store links generated through the App may also be used to place orders on the Website: where an order is placed through another customer's store link, that sharer earns a store link sharing reward at 100% (or, if they are a VIP Member, the 2,000% VIP sales benefit instead).

Points can only be credited to a registered account. If you check out as a guest without logging in, you will not earn base points for that order, and they cannot be claimed later by registering, although the person whose store link was used still earns their reward.

WE Reward points may only be redeemed on orders placed through the App — they cannot be used to pay for any part of a Website order. WE Reward points are governed by the WE Rewards Programme Terms and Conditions, which are incorporated into these Terms by reference. Full terms of the VIP Membership and StarWell Programme are set out in their respective Terms and Conditions, which apply only to your use of the mobile app.

The Website may request permission through your browser to access your device's precise location, for example to suggest a delivery address or show nearby store locations. You may allow or deny this permission, and may change your choice at any time in your browser settings; declining will not prevent you from using the Website, though some location-based features may be limited. See our Privacy Policy (Website) for further details on how location data is used.

All content on the Website, including trademarks, logos, text, graphics, product images, software and design, is owned by or licensed to us and is protected by Malaysian and international intellectual property laws. You may not copy, reproduce, distribute, modify or create derivative works from any part of the Website without our prior written consent.

We are not liable for any adverse reaction resulting from misuse of a product or failure to seek appropriate medical advice.

The Website is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except as required by applicable Malaysian law. We do not warrant that the Website will be uninterrupted, secure, or error-free.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Website, including but not limited to loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Malaysian law, including under the Consumer Protection Act 1999.

You agree to indemnify and hold harmless the Company, its directors, employees and agents from any claims, losses, liabilities and expenses arising from your breach of these Terms or your misuse of the Website.

Termination of your account does not affect any accrued rights or obligations relating to orders already placed. However, all remaining WE Reward points are forfeited in full upon closure of your account, whether closed by you or by us, and carry no cash or in-kind compensation. You are advised to redeem any remaining points through the App before closing your account.

We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from causes beyond our reasonable control, including natural disasters, acts of government, pandemics, power or network outages, or failures of third-party payment or delivery providers.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its original intent.

These Terms, together with the Privacy Policy (Website), the Refund, Return & Replacement Policy (Website), and the WE Rewards Programme Terms and Conditions, constitute the entire agreement between you and the Company regarding your use of the Website, and supersede any prior agreements or understandings on the same subject matter.

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of the Company to be effective.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a merger, acquisition, or sale of business assets.

These Terms are governed by the laws of Malaysia, and any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia. This applies to all users, whether in Malaysia or Singapore.

Nothing in this Section affects any mandatory consumer protection rights you may have under the laws of your country of residence which cannot be excluded by agreement.

We may amend these Terms from time to time. Updated Terms will be posted on the Website with a revised effective date, and your continued use of the Website after such changes constitutes acceptance of the updated Terms.
